A “conversion divorce” in New York State refers to a legal process where a couple that has been living apart under a separation agreement or a judicial separation for at least one year can convert that separation into a final divorce. This type of divorce is also known as a “conversion action.”The couple must have a written separation agreement that has been filed with the County Clerk or a judicial decree of separation. This agreement or decree must be in effect for at least one year.
